Terms of use for the recuto App

Welcome to recuto and the recuto App. These Terms of Use govern the relationship between users (hereinafter referred to as “Scouts”) and recuto GmbH (hereinafter referred to as “recuto”) as the provider of the app. By using the recuto App, Scouts expressly agree to be bound by these terms. Use of the recuto App is only possible under these conditions.

For the sake of readability, these Terms of Use do not differentiate between the male and female forms of language. The use of the female form applies to all genders.

Consent to Use 

By using the recuto App, Scouts agree to use the app in accordance with these Terms of Use as well as all applicable laws and regulations. Additionally, Scouts commit to adhering to recuto's privacy policies (see www.recuto.com/datenschutz).

Registration 

To access all features of the recuto App, including the ability to recommend suitable talents for job advertisements and the entitlement to a scout commission upon successful placement, registration in the recuto App is required. Scouts are obligated to provide truthful information and keep their login credentials secure. They bear sole responsibility for all activities conducted under their respective profiles.

Use of the recuto App and Scouts’ Diligence 

Scouts are not directly responsible for selecting suitable talents but are encouraged to share job advertisements with individuals whose qualifications, experiences, and career goals align well with the job requirements. This increases the chances of a successful placement.

Respectful interaction with other Scouts and potential talents is a fundamental aspect of using the recuto App. This includes mindful and courteous communication, consideration of individual preferences, and respect for the privacy of talents. Illegal, inappropriate, offensive, or discriminatory behavior is prohibited.

In the event of violations of this provision, recuto reserves the right to suspend or delete the account of the offending Scout.

Scout Commission for Successful Placement 

Scouts are entitled to receive a scout commission if a talent they recommended is successfully placed and hired by a company. The scout commission is paid in two installments:

  • 20% of the agreed commission upon the hiring of the talent.
  • The remaining 80% of the scout commission after the talent's three-month probationary period.

The amount of the scout commission varies depending on the job advertisement and is specified in the listing in the recuto App. The scout commission is paid within 30 days after the respective deadlines. recuto reserves the right to change or revoke the terms of commission payment at its discretion.

Scout commissions are considered additional income for tax purposes. Scouts are responsible for informing themselves about the tax implications and properly declaring their earnings. recuto assumes no liability for the tax matters of Scouts.

If a Scout provided incorrect information during registration in the recuto App (see point 2. Registration), recuto reserves the right to withhold the scout commission.

Data Protection for Scouts and Talents and Information on the Processing of Personal Data of App Users Under Art. 13 GDPR 

Scouts must ensure that a talent has consented to receive advertisements from recuto before forwarding job advertisements to them. Scouts may refer to recuto’s privacy policy at www.recuto.com/datenschutz to obtain this consent. Upon recuto’s request, Scouts must provide proof of the obtained consent.

In the context of using the recuto App, personal data of app users is processed for the purpose of fulfilling our personnel placement activities, sales activities, accounting, and support based on the legal grounds of an existing agreement (these Terms of Use) as well as for general marketing measures based on the legitimate interest in sending direct advertising and ensuring efficient business processes.

In addition to the technical telemetry data processed by our app, names, contact details, any agreements, and communication history are also processed.

The provision of the mentioned data is necessary for the business relationship, as otherwise, contractual or legal obligations cannot be fulfilled.

Processing is carried out in the name of recuto GmbH. Data will generally not be disclosed to third parties without consent, unless required by law or necessary for the fulfillment of contractual obligations (e.g., transmission to payment service providers for processing payments). Excluded from this is the transfer to processors who act solely on the instructions of recuto, do not use the data for their own purposes, and are bound by their own agreements to the data protection obligations of the General Data Protection Regulation.

Data may also be transferred to countries outside the European Union. To ensure the rights and freedoms of the affected individuals, agreements have been concluded in accordance with the standard contractual clauses approved by the European Commission (Art. 46 GDPR), and additional contractual commitments have been secured from the contracting partner to ensure a level of data protection comparable to that of the EU.

Data will be stored after the expiration of legal retention periods for a maximum of three years from the last contact. You have the right to access, correct, and delete the data, the right to restrict processing, to object to processing (particularly regarding the sending of direct advertising), as well as the right to data portability to another controller. You also have the right to lodge a complaint with a supervisory authority.

Intellectual Property 

All content, trademarks, and logos on the recuto App are the property of recuto or our licensors and business partners. These are protected by copyright. Use of these without prior written consent from recuto is prohibited.

Modification of the Terms of Use 

recuto reserves the right to change these Terms of Use at any time without prior notice. Changes will be announced in the recuto App and will take effect 30 days after publication. Continued use of the app after the announcement of changes will be considered acceptance of the revised Terms of Use.

Dispute Resolution 

Austrian law applies to all disputes related to these Terms of Use. recuto strives to resolve disputes through negotiation. If no agreement is reached, the dispute resolution will be subject to the jurisdiction of the court competent for recuto, currently the Commercial Court of Vienna, unless this conflicts with mandatory consumer protection regulations, particularly § 14 of the Austrian Consumer Protection Act (KSchG).
